Agile respects the privacy of its Website visitors (“Visitors”). This Privacy Policy discloses Agile’s information collection and dissemination practices in connection with the Website and applies solely to the information that we collect through the Website. This Privacy Policy does not address personal information that you provide to us in other contexts (e.g., through a business relationship not handled through the Website).

This can include but is not limited to: (a) your name, contact information, sex, and other registration information; (b) health information; (c) information you provide when submitting an employment application form; and (d) information you provide us when you contact us. If you report an experience or reaction involving one of our products, we may ask you for additional information, for example, to help us meet our reporting obligations under existing federal law. Any information collected about you from the website can, from time to time, be associated with other identifying information we have about you.

  1. Information automatically collected from you

We and our Service Providers (defined below) automatically collect certain technical information from your computer when you use our Website, such as your Internet Protocol address, your browser type, your operating system, the pages you view through the Website, the pages you view immediately before and after you access the Website, the length of time that you spend using the Website, and the search terms you enter through the Website. This information allows us to recognize you and personalize your experience if you return to the Website using the same computer, and to improve the website and the services we provide.   • as required by law including, but not limited to, to comply with a subpoena or other legal process, regulatory requirement, judicial proceeding, or court order served on us, to comply with government reporting obligations such as disclosing information you submit about your personal experiences with one of our pharmaceutical products (investigational or marketed) to the Federal Food and Drug Administration pursuant to federal regulations; when we believe in good faith that disclosure is necessary (a) to protect our rights, the integrity of the Website, or your safety or the safety of others, (b) to detect, prevent, or respond to fraud, intellectual property infringement, violations of any terms of use, violations of law, or other misuse of the Website, or (c) for corporate audits or to investigate or respond to a complaint or security threat; and

Aggregate Information may be collected when you visit the Website, independent of any information you voluntarily enter. Security

Agile understands that storing our data in a secure manner is essential. Agile stores PII and other data using industry standard physical, technical and administrative safeguards to secure data against foreseeable risks, such as unauthorized use, access, disclosure, destruction or modification. Please note, however, that while Agile has endeavored to create a secure and reliable website for users, the confidentiality of any communication or material transmitted to/from the Website or via e-mail cannot be guaranteed.

 

Response to “Do Not Track” Signals

Do Not Track (“DNT”) is a privacy preference that users can set in their web browsers. When a user turns on DNT, the browser sends a message to websites requesting that they do not track the user. At this time, we do not process or respond to these signals. We do not change our practices, described elsewhere in this Privacy Policy, in response to DNT browser settings or signals.

 

Children’s Privacy Protection

Our services are not intended for children under the age of 13. We do not knowingly collect personal information through the Website from visitors in this age group,. If you are under the age of 13, please do not submit any personal information through the Services. All users must be at least 18 years of age in order to use the Website.

Agile Therapeutics collects “personal information” as defined by the CCPA, which is information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household. In the past 12 months, Agile Therapeutics collected the specific type and categories of personal information indicate above in “Information Collected and Use” for the purposes indicated above in “Use and Disclosure of Personal Information.” The categories of third parties that we have disclosed such information to is indicated above in “Disclosure to Third Parties.”

How to Exercise Your Rights

If you wish to make a request to know or to delete your information, please email us at info@agiletherapeutics.com.  When submitting your request, please indicate your relationship with us as well as your specific request with enough information to allow us to understand and respond appropriately. We may request additional personal information from you in order to verify your identity. We will only use personal information provided in connection with a rights request under California law to review and comply with the request. If we are unable to verify your identity, we may decline a request to exercise rights under California law.

To make a request on your behalf, an authorized agent may contact us and include proof of your written and signed permission to do so. Note that Agile Therapeutics may also require you to verify your identity and confirm that you gave permission.  Once we are able to verify your identity, we will proceed with processing your request. Please note that there may be circumstances where we will not be able to honor your request.

Additional Information for Nevada Residents

Although Agile Therapeutics does not sell personal information, Nevada residents may have the right to opt-out of the any future sale of personal information we have collected or will collect. To make such a request, please email us at info@agiletherapeutics.com.

 

Changes

You may review and request changes to your PII that Agile has collected, including the removal of your PII from Agile’s databases in order to prevent receipt of future communications by making a request via e-mail to info@agiletherapeutics.com.

This Privacy Policy may be revised from time to time as we add new features and services, as laws change, and as industry privacy and security best practices evolve. We display an effective date on the policy in the upper right corner of this Privacy Policy so that it will be easier for you to know when there has been a change. If we make any change to this Privacy Policy regarding use or disclosure of PII, we will provide advance notice on this Website.
